The new tax credit provisions use the settlement date to determine your eligibility.  Since you settled on the home prior to President Obama signing the new bill, you don&#039;t qualify.  You indicated that this was not your first home but you may still qualify as a first time homebuyer under the previous tax credit provisions if you hadn&#039;t owned a home in the three previous years, or if you did own a home, rented it out.</description>
